The owner of a multi-million payment solution firm has protested multiple applications filed against him by the Directorate of Criminal Investigations (DCI) through the office of Director of Public Prosecution.
Businessman Kirimi Koome of Stay Online complained through his Cliff Ombeta that the endless applications filed by DCI amounted to misuse of judicial resources.
He told Milimani Chief Magistrate Lukas Onyina that the applications were a waste of judicial resources and an abuse of the court process.
Koome further said the court should put a stop to applications as the DCI was forum shopping and turning the courts into police posts and DCI offices.
Ombeta said it was in the interest of justice and the overriding objective principle for all applications relating to Koome be placed before the trial court.
“It is upon this premise that we humbly request that all applications emanating from MCCRE816 OF 2023 should be filed under MCCR F.816 OF 2023 having been put to notice of the existence of MCCRE816 OF 2023. The miscellaneous applications which are already in existence should be consolidated and placed before the trial court of MCCR E816 OF 2023,” says Koome through the letter to the CM.
The businessman has already been charged but that has not stopped the influx of miscellaneous applications to be filed against him seeking difference orders.
